1. These terms

This website is operated by Ergode. Throughout the site, the terms “we”, “us” and “our” refer to Ergode. By visiting this site or placing an order, you agree to the terms set out below. If you do not agree with them, please do not use the site.

We may update these terms. The version published here at the time you place an order is the version that applies to that order.

2. Using the site

You must be at least the age of majority in the place where you live to place an order. You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to interfere with its operation or security.

3. Products, descriptions and images

We describe every product as accurately as we can, including its materials and the sizes it is made in. Product photographs are intended to show the item honestly, but screens vary and colour, grain and finish can differ slightly from what you see. Wood is a natural material: grain and tone vary between individual pieces, and that variation is not a fault.

Where a listing states a dimension, a load rating or a compatible desk thickness, that figure is the one to rely on when deciding whether a product fits.

4. Availability and pricing

Products are offered subject to availability. We may change prices, edit or discontinue any product at any time, and we may limit the quantity of any item sold to one customer.

We make every effort to keep prices and product information correct. If an item is listed at an incorrect price or with a materially incorrect description, we reserve the right to cancel the order and refund you in full, whether or not the order has been confirmed.

5. Orders

Your order is an offer to buy. A confirmation email acknowledges that we have received it; the contract is formed when the order is dispatched. We may decline or cancel an order — for example where an item is unavailable, where payment cannot be taken, or where we suspect fraud — and we will refund any payment taken in full.

You are responsible for the accuracy of the details you provide at checkout, in particular the delivery address. See the shipping policy.

6. Payment

Payment is taken at checkout through our payment providers. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.

7. Shipping and returns

Delivery times, tracking and lost-parcel handling are set out in the shipping policy. Returns, refunds and the satisfaction guarantee are set out in the refund policy. Both form part of these terms.

8. Correct use of products

Desk hardware must be installed and used as its instructions describe, within any stated weight limit and on a desk it is compatible with. We are not responsible for damage caused by exceeding a stated load rating, by installing a product on an unsuitable surface, or by modifying a product.

9. Intellectual property

The content of this site — text, product descriptions, page design and the Ergode name — belongs to us and may not be copied or reused commercially without our written permission.

10. Third-party links

Where the site links to a third party, we are not responsible for that party’s content, products or policies, and a link is not an endorsement.

11. Limitation of liability

To the fullest extent permitted by law, our liability in connection with any product is limited to the amount you paid for it. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. This does not affect your statutory rights as a consumer.

How we handle personal information is set out in the privacy policy.

13. Severability

If any provision of these terms is found unenforceable, that provision applies to the fullest extent permitted and the remaining provisions stay in force.
